Terms Of Service

Effective Date: August 10, 2025

1. Overview

This website is operated by Click Statement Inc, doing business as OnlineWOD. The terms “we”, “us” and “our” refer to OnlineWOD. By accessing our website, purchasing a product, or using our services, you agree to these Terms of Service, our Refund Policy, and any other policies linked on this page.

By completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Refund Policy. If you do not agree, you may not use our website or purchase our products.

We may update or modify these Terms at any time by posting the revised version here. Your continued use of our site after changes are posted means you accept those changes.

2. Eligibility

You must be at least the age of majority in your place of residence, or have the consent of a parent or legal guardian, to use our services.

3. Products and Delivery

All OnlineWOD training programs are sold as digital files in PDF or similar formats and delivered electronically. No physical products are shipped.

Delivery is complete when download links or access instructions are provided to the email address you supplied at checkout. You are responsible for keeping your contact information accurate. Download links may expire for security reasons. If you need a new link, contact us and we will assist after verifying your purchase.

4. Technical Access Requirements

Some PDFs include clickable links to videos or other resources hosted by third parties. It is your responsibility to ensure your device, operating system, browser, PDF viewer, and internet connection can open these files and links. We recommend a current PDF viewer such as Adobe Acrobat Reader.

Links may not work on outdated devices, unsupported browsers, certain e-readers, or where a network or location blocks access. We are not obligated to provide a refund, exchange, or alternative access method if you fail to meet the stated technical requirements or if third-party hosting platforms experience downtime or remove content.

We do not provide technical support for third-party software, devices, or internet services. If you cannot access linked materials due to device, software, or connectivity issues, this does not constitute grounds for a refund.

Linked third-party content is subject to change or removal without notice. We are not responsible for maintaining or replacing third-party hosted resources.

We are not responsible for access issues caused by your hardware, software, settings, or connectivity.

5. Pricing, Currency, Taxes, and Payment

Prices are listed in United States Dollars unless stated otherwise. Your bank or payment provider may apply currency conversion fees.

Applicable sales taxes, including GST or HST for Canadian customers, are charged where required based on your billing address. Tax amounts are shown at checkout and on your receipt. GST or HST registration details are available upon request.

Payments are processed securely by third-party providers such as Stripe. By purchasing, you agree to comply with their terms.

6. Refunds and Chargebacks

Our full Refund Policy is available here. By purchasing, you agree that refunds are issued only if the product has not been downloaded and the request is made within 15 days of purchase. Once a file is downloaded, the sale is final.

If a refund is approved, payment processor fees such as Stripe transaction fees are non-refundable and will be deducted from the refund amount.

You agree not to initiate a chargeback unless the transaction was the result of proven fraud. Filing an unwarranted payment dispute or chargeback will be considered a breach of these Terms. We reserve the right to submit evidence to the payment processor to contest the dispute and to recover any associated costs, including legal fees, from you directly.

If you file a payment dispute without first contacting us to resolve the matter, we reserve the right to deny future purchases and pursue recovery of any associated costs.

7. License to Use

Upon purchase you receive a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use of the purchased materials. You may not resell, share, upload, post, publish, transmit, distribute, sublicense, or otherwise make the materials available to any other person or platform without our written permission.

8. Copyright and Intellectual Property

All materials provided by OnlineWOD, including PDFs, videos, text, graphics, and other content, are protected under Canadian, United States, United Kingdom, and international copyright and intellectual property laws. Unauthorized use may result in immediate revocation of access and legal action, including claims for damages.

9. User Conduct and Prohibited Uses

You agree that you will not:

  • Use our site or content for unlawful purposes
  • Share account access or download links
  • Attempt to bypass access controls
  • Upload or transmit malicious code
  • Copy, modify, or distribute our content without permission

We may suspend or terminate access for violations of these Terms.

10. Third-Party Tools and Links

Our PDFs and pages may contain links to third-party websites or services. These are provided for convenience only. We do not control and are not responsible for third-party websites, content, availability, performance, or policies. Any use of third-party sites is at your own risk.

12. Disclaimer of Warranties

Our website, products, and services are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free access, compatibility with every device or viewer, or any particular fitness result.

13. Limitation of Liability

To the fullest extent permitted by law, OnlineWOD and its owners, officers, employees, contractors, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from or related to your use of our website or products. Where liability cannot be excluded, our total liability will not exceed the amount you paid in the three months before the claim arose.

14. Indemnification

You agree to indemnify and hold harmless OnlineWOD and its affiliates from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your breach of these Terms or your misuse of our website or products.

15. Accuracy, Errors, and Omissions

From time to time there may be information on the site or in our materials that contains typographical errors or inaccuracies, including in descriptions, pricing, promotions, or availability. We reserve the right to correct errors, change or update information, or cancel orders if any information is inaccurate, at any time and without notice, including after an order is submitted.

16. Severability and Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force. No waiver of any term will be a further or continuing waiver of that term or any other term.

17. Entire Agreement and Assignment

These Terms, together with the policies referenced here, are the entire agreement between you and OnlineWOD regarding your use of the site and products. They supersede any prior agreements or communications. You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations at any time.

18. Governing Law and Venue

These Terms are governed by the laws of Canada and the laws of the Province of Ontario, without regard to conflict of law rules. Any dispute will be brought exclusively in the courts located in Ontario, Canada.

If you access our services from outside Canada, you are responsible for compliance with your local laws. All disputes remain subject to Canadian jurisdiction as stated in this section.
